Profile

Michael has a broad range of intellectual property experience, and focuses a significant amount of his practice on patent litigation, patent prosecution, and post-grant review proceedings before the Patent Trial and Appeal Board at the United States Patent and Trademark Office (USPTO), particularly as they relate to ongoing litigation.

He has helped clients navigate their strategic options in dealing with intellectual property, whether acquiring and protecting intellectual property rights, defending against allegations of infringement, challenging the intellectual property rights of others, or resolving other intellectual property disputes.

Michael’s litigation and patent practice work has been concentrated in the electrical, mechanical, telecommunications, software and energy industries. He has worked across a wide spectrum of technologies, including vehicle navigation, network communication, hybrid and electric power, lighting, entertainment, collision avoidance, and control systems, communication networks, signal processing devices, mobile applications and electronic software licensing systems.

Michael also has an active utility and design patent prosecution practice, and has represented industry leaders before the USPTO in diverse fields, such as vehicle navigation, display and sensor systems, surgical devices, solar and wind energy systems, energy storage devices, and systems for structuring and operating financial markets and auctions, among others.

Relevant Experience

  • Represented electric motor manufacturer Nidec Corporation in a patent infringement action brought by Intellectual Ventures II LLC before the International Trade Commission, relating to electric motor technology. Representation also included challenging patent validity before the Patent Trial and Appeal Board of the United States Patent and Trademark Office.
  • Represented automotive manufacturer Volkswagen Group in a patent infringement action brought by Advanced Media Networks, LLC in the United States District Court for the District of Delaware, relating to in-vehicle Wi-Fi hotspot technology.
  • Represented automotive manufacturer Volkswagen Group in a patent infringement action brought by Beacon Navigation GmbH before the International Trade Commission and the United States District Court for the Eastern District of Michigan, relating to vehicle navigation technology. Representation included challenging patent validity before the Patent Trial and Appeal Board of the United States Patent and Trademark Office.
  • Represented a large corporation in a derivation action before the Patent Trial and Appeal Board of the United States Patent and Trademark Office.
  • Represented automotive manufacturer Volkswagen Group in a patent infringement action brought by Blitzsafe Texas, LLC in the United States District Court for the Eastern District of Texas, relating to technology for wireless connectivity of in-vehicle mobile devices. Representation included challenging patent validity before the Patent Trial and Appeal Board of the United States Patent and Trademark Office.
  • Represented automotive manufacturer Volkswagen Group in a patent infringement action brought by Joao Control & Monitoring Systems, LLC in the United States District Court for the District of Delaware, relating to remote control and monitoring technology. Representation included challenging patent validity before the Patent Trial and Appeal Board of the United States Patent and Trademark Office.
  • Represented automotive manufacturer Volkswagen Group in a patent infringement action brought by Paice LLC before the International Trade Commission, relating to hybrid vehicle technology. Representation included challenging patent validity before the Patent Trial and Appeal Board of the United States Patent and Trademark Office.
  • Represented automotive manufacturer Volkswagen Group in a patent infringement action brought by Signal IP in the United States District Court for the Central District of California, relating to vehicle safety sensor and radar technology. Representation included challenging patent validity before the Patent Trial and Appeal Board of the United States Patent and Trademark Office.
  • Represented automotive manufacturer Volkswagen Group in a patent infringement action brought by West View Research, LLC in the United States District Court for the Southern District of California, relating to vehicle computing technology. Representation included challenging patent validity before the Patent Trial and Appeal Board of the United States Patent and Trademark Office.
  • Represented online retailer The Jewelry Channel, Inc. USA in a patent infringement action brought by Jewelry Television in the United States District Court for the Eastern District of Tennessee. Representation included challenging patent validity before the Patent Trial and Appeal Board of the United States Patent and Trademark Office.
