Practice focuses on commercial real estate financing and restructuring transactions.

Nadia Burgard has a broad array of experience in real estate financing and restructuring transactions, including representing private equity clients in multi-property mortgage and mezzanine loan acquisition finance transactions and representing both buyers and lenders, as well as sellers and borrowers in commercial mortgage loan repurchase and loan-on-loan facilities. She also has extensive experience assisting clients with leveraged acquisitions, asset-based financings, workouts, and debtor-in-possession and exit financings. Ms. Burgard’s clients include financial institutions and private equity sponsors and their portfolio companies in leveraged credit and structured finance transactions.

Relevant Experience

  • Represented global private equity firm in a $5.122 billion Freddie Mac financing to acquire and take private a public apartment REIT owning 120+ apartment communities in nine states.
  • Represented life insurance company in a $500 million repurchase warehouse facility financing the company’s origination of commercial mortgage and mezzanine loan assets under its commercial mortgage loan financing platform.
  • Represented global private equity firm in $2 billion of repurchase facilities financing the acquisition of a portfolio of distressed commercial mortgage loans.
  • Represented life insurance company as buyer in a $750 million repurchase warehouse facility for commercial mortgage loans originated by a REIT seller under its commercial mortgage loan financing platform.
  • Represented global private equity firm in the $938 million mortgage and mezzanine acquisition financing for over 100 office and industrial properties and the securitization of the mortgage and a mezzanine loans.
  • Represented global private equity firm in a $900 million term repurchase facility financing the firm’s origination and acquisition of commercial mortgage loan assets.
  • Represented global private equity firm in the $582 million mortgage and mezzanine acquisition financing for 38 limited service and extended stay hotels, and the securitization of the mortgage and a mezzanine loans.
  • Represented global private equity firm in connection with repurchase facilities financing the acquisition of a portfolio of $450 million of distressed commercial mortgage loans.
  • Represented financial institutions in connection with disposition, restructuring of, and the risk management for a portfolio of ABS, RMBS, CMBS, and CDO assets totaling in excess of $25 billion.
  • Represented global private equity firm in connection with the financing of the acquisition from the original lender of a portfolio of $480 million of distressed commercial mortgage loans.
